                                    misconduct will be subject to disciplinary action.False reporting may also violate state criminal statutes and civil defamation laws.EFFECTIVE DATEThe College reserves the right to make changes and amendments to this Policy as needed, with appropriate notice to the campus community.However, the Policy in force at the time that a Complaint is filed will be the Policy used throughout the investigation, hearing, and any appeals.RETENTION OF RECORDSFor a period of at least seven years, the College will maintain the records of:%u2022Each sexual harassment investigation, including any determination regarding responsibility, any recordings or transcripts, disciplinary sanctions, and remedies provided to the complainant %u2022Any appeal and the result therefrom%u2022Any informal resolution and the result therefrom %u2022All materials used to train Title IX Coordinators, investigators, decisionmakers, and any person who facilitates an informal resolution process. These materials will be made publicly available on the College%u2019s website.%u2022Records of any actions, including supportive measures, taken in response to a report or formal complaint of sexual harassment, along with documentation of the College%u2019s bases for its conclusion that its response was not deliberately indifferent. Documentation pertaining to terminations, expulsions or educational sanctions may be retained indefinitely.Rights of the Parties in an Institutional Proceeding:During the course of the process described in the previous section, both the accuser and the individual accused of the offense are entitled to: 1.A prompt, fair and impartial process from the initial investigation to the final result. oA prompt, fair and impartial process is one that is: %uf0a7Completed within reasonably prompt timeframes designated by the institution%u2019s policy, including a process that allows for the extension of timeframes for good cause, with written notice to the accuser and the accused of the delay and the reason for the delay. %uf0a7Conducted in a manner that: %uf0a7Is consistent with the institution%u2019s policies and transparent to the accuser and the accused. %uf0a7Includes timely notice of meetings at which the accuser or accused, or both, may be present; and
