                                    Crime Type (Arkansas Code)DefinitionsRape, Fondling, Incest, Statutory RapeFor purposes of the Clery Act, the term %u201csexual assault%u201d includes the offenses of rape, fondling, incest, and statutory rape. These definitions under Arkansas law are as follows:%u2022Rape (Ark. Code %u00a7 5-14-103): A person commits rape if he or she engages insexual intercourse or deviate sexual activity with another person:oBy forcible compulsion.oWho is incapable of consent because he or she is: (A) Physically helpless; (B) Mentally defective; or (C) Mentally incapacitated.oWho is less than fourteen (14) years of age.oWho is a minor and the actor is the victim's: (i) Guardian; (ii) Uncle, aunt, grandparent, step-grandparent, or grandparent by adoption; (iii) Brother or sister of the whole or half blood or by adoption; or (iv) Nephew, niece, or first cousin.%u2022Capital rape (Ark. Code %u00a7 514114): A person commits capital rape if:oHe or she engages in sexual intercourse or deviate sexual activity with another person who is thirteen (13) years of age or younger and causes or threatens to cause serious physical injury to that person;oActing alone or with one (1) or more other persons:A.The person commits or attempts to commit: The person commits or attempts to commit: (i) Terrorism, %u00a7 554205; (ii) Kidnapping, %u00a7 511102; (iii) Vehicular piracy, %u00a7 511105; (iv) Robbery, %u00a7 5%u201312%u2013102; (v) Aggravated robbery, %u00a7 5%u201312%u2013103; (vi) Residential burglary, %u00a7 5%u201339%u2013201(a); (vii) Commercial burglary, %u00a7 5%u201339%u2013201(b); (viii) Aggravated residential burglary, %u00a7 539204; (ix) A felony violation of the Uniform Controlled Substances Act, %u00a7%u00a7 5%u201364%u2013101 %u20145%u201364%u2013508, involving an actual delivery of a controlled substance; (x) First degree escape, %u00a7 5%u201354%u2013110; (xi) Trafficking of persons, %u00a7 518103; (xii) Engaging children in sexually explicit conduct for use in visual or print medium, %u00a7 5%u201327%u2013303; or (xiii) Transportation of minors for prohibited sexual conduct, %u00a7 5%u201327%u2013305; andB.During the course of or in furtherance of the offense under subdivision (a)(2)(A) of this section, the person engages in sexual intercourse or deviate sexual activity with another person who is thirteen (13) years of age or younger;C.While using or threatening to use a deadly weapon, he or she engages in sexual intercourse or deviate
